Travel Agreement
The Company and the Client are collectively referred to herein as the “Parties.”
WHEREAS, the Company provides travel and tour services; and
WHEREAS, the Client desires to engage the Company to provide such services, subject to the terms and conditions set forth in this Agreement.
NOW, THEREFORE, in consideration of the mutual covenants and promises contained herein, and for other good and valuable consideration, the receipt and sufficiency of which are hereby acknowledged, the Parties hereby agree as follows:
Fitness For Travel
The Client represents and warrants that they are physically and mentally fit for travel, and that they do not have any medical conditions or other circumstances that may affect their ability to participate in the travel or tour organised by the Company. The Client acknowledges that it is their sole responsibility to ensure their fitness for travel and participation in the tour.
Additional Care
In the event that the Client requires additional care, support, or assistance during the travel or tour, the Client shall be solely responsible for arranging and providing such care, support, or assistance at their own expense. The Company shall not be responsible for providing or arranging any additional care, support, or assistance to the Client. PAYMENT The Client shall pay the Company the full amount for the travel and tour services by the due date specified by the Company. Failure to make payment in full by the due date shall constitute a material breach of this Agreement and may result in the cancellation of the Client’s reservation without any refund.
Payment

Travel Insurance
Travel insurance is compulsory for all Clients participating in the Company’s travel and tour services. The Client shall obtain, at their own expense, a comprehensive travel insurance policy that covers, at a minimum, medical expenses, personal accident, loss of baggage, and cancellation or curtailment of the trip. The Client shall provide proof of such insurance to the Company prior to the commencement of the travel or tour.
Non-Refundable Fees
The Client acknowledges and agrees that all fees paid for the travel and tour services, as well as the travel insurance, are non-refundable once paid, except as otherwise provided by applicable law or the terms of the relevant insurance policy. No refunds will be issued for cancellations, changes, or modifications made by the Client after payment has been made.
Itinerary Times & Changes
The Client acknowledges and agrees that the itinerary times provided by the Company are subject to change. The Company shall make reasonable efforts to adhere to the timelines specified in the itinerary; however, the Company shall not be liable for any delays, changes, or modifications to the itinerary that may occur due to circumstances beyond its control, including but not limited to weather conditions, transportation issues, or other unforeseen events.
In the event that the Client misses a connection or departure due to their own actions or inactions, or as a result of any changes or modifications to the itinerary, the Client shall be solely responsible for covering any additional costs required to re-join the tour or arrange alternative travel plans. The Company shall not be responsible for providing any refunds, compensation, or assistance in such circumstances.
Passports, Visas and Health Requirements & general travel advice
It is your responsibility to ensure that you have the required documents, including visas and passports, before travelling to a destination. Please check with the respective Embassy or Consulate of each country that you are travelling to, as many destinations require visas for both Australians and non-Australian passport holders. You need to ensure that you have at least 6 months validity on your passport from the date you leave your destination.
We recommend that you contact the Department of Foreign Affairs and Trade (DFAT) or visit their website at www.dfat.gov.au for general travel advice, as well as specific advice (including safety alert levels) relating to the destination you wish to visit.
Airline Schedule changes and/or flight cancellations made by airline up to and including date of travel.
You agree to check your flight status up to and including the date of travel for any schedule changes and /or cancellations. Your airline reference and flight numbers are noted on your e-ticket. It is your responsibility to advise us if you have not received your e-tickets. We (Mercedes Travel) are not responsible for costs associated with airline changes.
